Terms of Service

Subject to your compliance with these Terms and payment of the applicable license fee, Trapalanda LLC grants you a perpetual, non-exclusive, non-transferable license to use the Kiban BOS software in your projects as permitted by your license tier.

“Perpetual” means the version of the software available at the time of your purchase (and all versions released during your active update period) remains licensed to you indefinitely, even if you do not renew your update subscription. See our License Agreement for full details on the perpetual license model.

You may use the Kiban BOS to:

• Build commercial and non-commercial software applications.
• Deploy as many production instances as permitted by your license tier.
• Modify the source code for your own use.

You may not:

• Resell, sublicense, or redistribute the Kiban BOS source code as a standalone product.
• Create a competing product based substantially on the Kiban BOS codebase.
• Remove or alter copyright notices or attributions from the source code.
• Use the software in applications that facilitate illegal activity.
• White-label the software without an Enterprise license with white-label addendum.

We offer a 14-day money-back guarantee on all license tiers. If you are not satisfied with your purchase for any reason, contact us within 14 days of the purchase date at licenses@kiban.dev for a full refund, no questions asked.

After 14 days, we do not offer refunds on license purchases. Annual subscriptions that are canceled mid-term will not receive a prorated refund, but you will retain access until the end of the paid period.

All prices are in USD unless otherwise stated. Applicable taxes (VAT, sales tax) may be added at checkout depending on your jurisdiction. If you use Lemon Squeezy as your processor, Lemon Squeezy acts as the Merchant of Record and handles all tax compliance on our behalf.

Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

The Kiban BOS source code, documentation, and brand assets are the intellectual property of Trapalanda LLC. Your license grants you rights to use the software — it does not transfer ownership of any intellectual property.

Any modifications you make to the source code for your own projects remain your intellectual property. You grant Trapalanda LLC no rights over your modifications.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRAPALANDA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the software will be error-free, uninterrupted, or free of security vulnerabilities. You are responsible for your own data backup and security posture when self-hosting the Kiban BOS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAPALANDA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL TRAPALANDA LLC’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO TRAPALANDA LLC IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM.

These Terms are governed by the laws of Argentina, without regard to conflict of law principles. Any disputes shall be resolved by the courts of Buenos Aires, Argentina, unless otherwise required by your local consumer protection laws.

We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
